Privacy Notice

SNDA EXPLORACIÓN, S. de R.L. de C.V. (“Sinda.”), with address at Calle Lava #206, Colonia Jardines del Moral., CP 37160 León de los Aldamas , Guanajuato, Mexico, in compliance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (the “Data Protection Law”), makes known to clients, both natural persons and legal persons (the “Clients”), the following privacy notice (the “Privacy Notice”):

Processing of Personal Data

Sinda will collect the personal data of Clients with whom it has or may have a business relationship (the “Data Subjects”) for the purposes mentioned in this Privacy Notice. This data will be processed at all times in accordance with the principles of lawfulness, consent, information, quality, purpose, loyalty, proportionality, and accountability, and always in compliance with the provisions of the Data Protection Law.

All data of the Holders is provided voluntarily and may consist of, but is not limited to, the following: name or business name, address, telephone, Federal Taxpayer Registry, bank details, name of the contact person, name of the legal representative, business activity or corporate purpose, among others.

Sinda informs the Data Subjects that, under no circumstances, will it request sensitive personal data, which includes those that may reveal aspects of racial or ethnic origin, health status, genetic information, religious, philosophical and moral beliefs, union affiliation, political opinions or sexual preference.

Purpose of Processing Personal Data

Sinda collects personal data for the following purposes:

1. Carry out the registration and identification of the Holders, as well as the updating of the databases of the same.
2. To have direct contact with the Holders, as well as to carry out any negotiation that may result in any commercial relationship with them.
3. To carry out payment procedures and any other procedures derived from the relationship with the Holders.
4. Follow up on any request or communication made by the Data Subjects.
5. Send them relevant information about Sinda.

Limitation on the Use of Personal Data

Sinda safeguards personal data in databases under security measures and limited access, specially implemented to prevent any unauthorized use, destruction or processing of the personal data provided.

ARCO rights

Data Subjects have the right at any time to exercise their right of access, rectification, cancellation and opposition (“ARCO Rights”), in relation to the personal data they provide to Sinda.

ARCO Rights consist of the right of the Holders at any time to request the rectification or correction of the personal data provided when these are inaccurate or incomplete; access to the personal data that Sinda has in the databases; the cancellation or deletion of the personal data that Sinda has collected by virtue of the commercial relationship.

To exercise ARCO Rights, Data Subjects must send their request in writing and in free format to the following email address: contacto@sinda.mx, which must be addressed to Ireri Rico so that Data Subjects can indicate the right they wish to exercise, as well as the reason that motivates said exercise, providing the following information:

1. Full name.
2. Documents that prove the identity or, where applicable, legal representation of the Holder.
3. Home address.
4. Request and motivation regarding the data for which you wish to exercise ARCO Rights.

The responsible party will communicate to the Holder, within a maximum period of 20 (twenty) days, counted from the date on which the request with the complete information was received, exercising any of the ARCO Rights, the response, as well as the decision adopted, so that, if it is appropriate, Sinda will make the request effective within 15 (fifteen) days following the date on which the response is communicated to the corresponding Client.

In the case of requests for access to personal data, Sinda will proceed to deliver to the Data Subjects the information that it has in the databases.

Should the Client wish to cancel their personal data, this request will result in a blocking period, after which the requested data will be deleted. Sinda may retain the data solely for purposes related to its legal responsibilities arising from the processing. The blocking period will be equivalent to the statute of limitations for actions arising from the legal relationship that forms the basis of the processing, in accordance with the applicable law for each specific matter.

Transfer of Personal Data

Sinda refrains at all times from selling, assigning or transferring the personal data provided by the Holders to any third party.

Notification of changes to the Privacy Notice

Likewise, Sinda may send notifications to the Data Subjects via email, in order to inform the Data Subjects of any changes related to this Privacy Notice.

Acceptance of the Privacy Notice

The Client acknowledges that they are aware of this Privacy Notice and agree to its terms.
